BOOKING TERMS

We look forward to welcoming you at the Heriot Row Apartment.  This page simply sets out the terms of the agreement.  Please read it and make sure you understand it.  Overall it is pretty straight forward, we like to keep it simple and just ask you to treat the apartment as it if was your home. If you have any questions, please just ask.

Your Booking:

  • Check in & Check out Time:  You can arrive at your accommodation after 15:00 hours on the Arrival Date of your holiday and we ask you leave by 11:00 hours on the Departure Date.  However we understand that flight and travel plans mean that you may arrive early or leave late at night, and we have secure storage for your luggage if that happens.  However, whilst we take security seriously – the luggage is your responsibility. Also check in and check out times are relaxed when we have no back to back bookings.

  • Your deposit:  We ask for a security deposit over and above the rental cost.  This is to cover any breakages or issues.  At the end of your stay, the property will be inspected and if there are any problems we will contact you immediately.  However we hope to return your deposit to you within 7 days, normally it will be within 2-3 days. 

  • If you wish to cancel or amend your booking:  Please contact us within 45 days before your booking and we will gladly amend or cancel your booking - there is a small administration charge of £30.  For reservations longer than 7 nights and/or during the period of Edinburgh Festival, Easter, Rugby Weekend, Christmas or New Year – any changes or cancellations must be made 60 days prior to arrival. If you wish to cancel or amend and it is less than 45/60 days, we will do our very best to try and accommodate your request. We reserve the right to retain the rental cost where we have not been able to re-let the property.  Covid-19 Update:  We understand that things are very uncertain and is not clear when travel will return to normal.  In light of this, any booking made after 1st April 2020 for a stay in 2020 can be cancelled for a full refund up to 2 days prior to arrival.

  • If we cancel or amend your booking:  We would not expect to have to make any changes to your booking, but in the rare event a problem does occur, we may have to make alterations or cancel bookings.  So far this has never happened, however if this does happen, we will contact you as soon as is reasonably practical and inform you of the cancellation or the change to your booking. If it is necessary to cancel your booking, we will refund the balance of any money you have paid us.

  • Stag & Hen Parties:  The property is not available for stag or hen weekends.  If a stag or hen party is found to have booked the property, then the booking will be cancelled immediately and/or the party will be refused access to the property.  We reserve the right to retain the rental cost, however the damage deposit will be refunded to you.

General House Rules:

  • Smoking: Smoking is not allowed.  If any smoking has occurred inside or the ashtray has not been used outside, a charge will be made.

  • Accidents & Liability: We are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. We are not responsible for the loss of personal belongings or valuables of the guests. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises.

  • Pets: Pets are not allowed unless prior approval is obtained.

  • Inspection: We have the right to inspect the premises without prior notice at any time to enforce the terms of this agreement. Should the Guests violate any of the terms of this agreement, the rental period shall be terminated immediately. The Guests waive all rights to process if they fail to vacate the premises upon termination of the rental period. The Guests shall vacate the premises at the expiration time and date of this agreement.

  • General Good Terms: The Guests shall maintain the premises in a good, clean, and ready to rent condition, and use the premises only in a careful and lawful manner. The Guests shall leave the premises in a ready to rent condition at the expiration of the rental agreement, defined by us as being immediately habitable by the next guests. Guests shall pay for maintenance and repairs should the premises be left in a lesser condition. The Guests agree that we shall deduct costs of said services from the security deposit prior to refund if tenants cause damage to the premises or its furnishings.

  • Waste: The Guests shall dispose of all waste material generated during the rental period in a lawful manner and put the rubbish bags in the front outhouse.

  • On Departure: The Guests are asked to leave the property in good condition – whilst we have a cleaning service, we ask all guests to be respectful on how they leave the property.  Things like kitchen surfaces cleaned and furniture in the original position are examples of things that would help/expect.  We reserve the right to charge for additional cleaning if the property is not left in a good condition.

  • Subletting: The Guests shall not sublet the property.

 

  • Property Keys: Guests will be responsible for the property keys and will return all keys at the end.  If keys are lost or not returned a charge will be made.

  • Our liability – Our maximum liability for losses you suffer as a result of us acting in breach of these terms is strictly limited to the total fees you have paid for the Booking.  We shall not be liable for any losses which are not a foreseeable consequence of us breaking these Booking Conditions.  Your booking is made as a consumer for the purpose of a holiday and you acknowledge that we will not be liable for any business losses howsoever suffered or incurred by you. We shall not be liable to you for any personal injury or damage to or loss of personal property, except where the injury, damage or loss is caused by our negligence.

  • Terms: The contract between you and us is governed by the law of Scotland and we both agree that any dispute, matter or other issue which arises between us will be dealt with by the Courts of Scotland.
